s57 Letter

An s57 Natural Justice letter, also known as an ‘Invitation to Comment letter’, is sent by the Department of Immigration and Border Protection (DIBP) when the case officer assessing the visa application suspects a bogus document or misleading information has been provided. It could also mean that your health assessments results indicate that you may not pass a health test or require a health waiver. 

Other situations include issues with previous visa compliance, criminal record, previous unlawful status in Australia or applicable exclusion periods. 

How to respond

You must communicate with a decision-maker within the given deadline concisely and accurately. Keep your response simple and to the point:

  • Only answer to the issues raised in the letter. Excessive information can raise additional issues that were not relevant to this request.
  • It would help if you had a chronology of relevant events in your immigration journey.
  • Choose the most potent evidence and eliminate unnecessary material.
  • Provide detailed medical reports.
  • Provide an accurate psychologist assessment.

Importantly, always review submissions prepared by Migration Agents or Lawyers before they submit to the Department on your behalf.
